1. Agreement to Terms

By accessing or using the DashGreen application or website ("the Platform"), you agree to be bound by these Terms and Conditions. If you do not agree, you may not use the Platform. These Terms constitute a binding legal agreement between you and DashGreen (Pty) Ltd.

3. Eligibility

To use the Platform, you must:

• Be at least 18 years of age
• Complete identity and age verification as required by the Platform
• Provide accurate, truthful, and current information at all times
• Use the Platform in accordance with all applicable South African laws

By creating an account, you confirm that you meet all eligibility requirements. Providing false information, including false age information, will result in immediate account termination and may result in legal action.

4. Age Verification

Where age-restricted products are available on the Platform, the following applies:

• You must be 18 years or older to access, view, or order age-restricted products
• You must complete DashGreen's age verification process before accessing age-restricted sections
• Providing false age information or fraudulent identity documents is a criminal offence under South African law
• Drivers are instructed to verify the recipient's ID upon delivery of age-restricted products and to refuse delivery where the recipient cannot produce valid identification or appears to be under 18
• Partner clubs are solely responsible for ensuring compliance with all applicable laws regarding the supply of age-restricted products

5. Membership

Certain products and services on the Platform are accessible only to verified members of partner clubs. Membership is governed by the separate terms and conditions of each respective club. DashGreen acts only as the technology facilitator and is not a party to any club membership agreement.

Membership fees, where applicable, are paid directly to the relevant club and are non-refundable unless otherwise stated by the club.

6. Orders & Payments

All orders placed through the Platform are subject to acceptance and availability confirmation from the partner club and successful payment processing. Prices and applicable fees are displayed before checkout.

Payments are processed securely via third-party payment providers. DashGreen does not store full card details. DashGreen charges a platform service fee for technology and logistics facilitation. This fee is for platform access and is separate from the cost of products.

7. Deliveries

• Delivery times displayed are estimates only and are not guaranteed
• You are responsible for providing accurate delivery information
• Risk of products transfers to you upon successful delivery to the address provided
• Drivers may request to verify your identity upon delivery of age-restricted products
• Refusal to provide identification will result in the delivery being cancelled with no refund

8. Independent Drivers

All delivery drivers operating on the DashGreen Platform are independent contractors, not employees of DashGreen. DashGreen does not control the day-to-day conduct of drivers and is not liable for the actions, omissions, or negligence of independent drivers.

9. Partner Clubs & Stores

All stores and partner clubs listed on the Platform are independent businesses. They are solely responsible for the legality, quality, safety, and accuracy of all listed products, compliance with all applicable South African laws and regulations, age verification at the point of supply, and any licences, permits, or registrations required to operate.

10. Prohibited Conduct

You may not use the Platform to engage in any unlawful activity, supply false identity or age information, harass or harm other users, attempt to defraud DashGreen or partner clubs, interfere with the Platform's systems or security, or resell or redistribute products purchased through the Platform.

11. Dispute Resolution

If you have a dispute relating to an order, delivery, or payment, contact DashGreen support at support@dashgreen.co.za within 48 hours of the issue. DashGreen will investigate and respond within 5 business days. These Terms are governed by the laws of the Republic of South Africa.

12. Limitation of Liability

To the maximum extent permitted by South African law, DashGreen is not liable for the actions of independent drivers or partner clubs, product quality or compliance, delivery delays or failures beyond our control, or any indirect or consequential damages arising from use of the Platform.
